Text Messaging and Emails

By agreeing to receive text messages and emails from or on behalf of Palm Beach Tan, Inc. (“PBT,” “we,” “us,” or “our”), you agree to be bound by these Text Messaging and Email Terms, the Privacy Policy, and any other applicable terms related to your use of PBT’s services.

By providing us your email and/or telephone number—or otherwise agreeing to receive text messages and/or emails from or on behalf of PBT—you expressly consent to receive promotional, informational, and marketing and/or non‐marketing communications from PBT and any and all others communicating on PBT’s behalf, including but not limited to service partners. These communications may be sent using an automated telephone dialing system (“ATDS”), autodialer, or other automated technologies, at the mobile telephone number associated with your opt-in. You may opt out of these communications at any time. Your consent to receive marketing text messages and emails is not required and is not a condition of purchasing any goods or services.

Program Descriptions

PBT and/or its service providers may deliver text messages (including SMS and MMS) to the phone number(s) that you provide. Text messaging may include one-time or recurring texts related to, but not limited to, the following programs:

  • Marketing and Promotional Programs
  • Informational Account and Service Updates

Message Types

You may receive promotional, informational, or marketing text messages from PBT.

Message Frequency

Message frequency will vary depending on the program(s) in which you enroll. Typically, you can expect to receive up to 6 text messages per month.

Cost Notice

Message and data rates may apply. Please check with your mobile carrier regarding your specific pricing plan. You are solely responsible for any costs related to or associated with your receipt of text messages.

How to Opt Out of Text Messaging

If you do not wish to continue participating in any text messaging program, or no longer agree to these Terms, you may directly reply to any message received from that program with “STOP,” “END,” “CANCEL,” “UNSUBSCRIBE,” or “QUIT” to opt out. You may also text “STOP” to 69826. You may receive one additional mobile message confirming your decision to opt out.

How to Opt Out of Email Communications

You may unsubscribe from marketing and promotional emails by clicking the “Unsubscribe” link at the bottom of any marketing email, by updating your communication preferences in your account, or by contacting us using the information provided in our Privacy Policy.

Supported Carriers

Not all mobile devices or handsets may be supported, and messages may not be deliverable in all areas. PBT, its service providers, and the supported mobile carriers are not liable for delayed or undelivered messages.

MMS Disclosure

Where applicable, PBT programs may send MMS (Multimedia Messaging Service) messages. If your device does not support MMS, you may receive SMS (Short Message Service) messages instead.

Access or Delivery to Mobile Network Is Not Guaranteed

Text messaging services are offered on an “as‐is” basis and may not be available in all areas at all times. Delivery of mobile messages is subject to effective transmission by your wireless carrier/network operator and is outside our control. PBT is not liable for delayed or undelivered messages.

Participant Device and Service Requirements

You must have your own wireless device capable of two-way messaging, use a participating wireless carrier, and be a wireless service subscriber with text messaging service. Check your device for specific text messaging capabilities.

Eligibility

Individuals under the age of 18 may not participate in text message communications with PBT, and parents or legal guardians may not agree to these Terms on their behalf. If we become aware that a child under 18 has provided or attempted to provide us with personal information, we will use our best efforts to remove it from our files. If you are under the age of 18 but at least 16 years old, you may participate only under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. If you are a parent or legal guardian agreeing to these Terms for a minor, you are fully responsible for the minor’s participation, including all legal liability incurred.

Revisions to Terms and Conditions

We reserve the right, at our sole discretion and without notice, to change, modify, add, or remove any portion of these Terms at any time. Changes will be effective when posted, and your continued use of PBT services after changes are posted constitutes acceptance of those changes.

Choice of Law

These Terms, and any disputes related to them, are governed by the laws of the State of Texas and the federal laws of the United States of America, without regard to any conflict‐of‐laws principles that would apply another jurisdiction’s laws.

Partial Invalidity

If any provision of these Terms is deemed unenforceable by a court of competent jurisdiction, that provision shall be enforced to the fullest extent permissible so as to carry out the intent of these Terms, and the remainder shall continue in full force and effect.

Limitation of Liability

In no event will PBT be liable for any direct, indirect, special, compensatory, consequential, or incidental damages arising out of or relating to your participation in text messaging or email services, including any damages resulting from communications with other users or persons introduced to you through our services.

In no event will PBT be liable for any incidental, special, consequential, or indirect damages, including but not limited to loss or corruption of data or service interruptions. Our total liability (whether in contract, tort, or any other theory) in connection with these Terms shall not exceed the amount you paid to PBT, if any.

Because some jurisdictions do not allow the exclusion or limitation of certain damages, these limitations may not apply to you.
